These Terms of Service ("Terms") govern your use of Trade Bot (Trade Bot AI Strategy platform) operated by Orpyxis Technologies ("Orpyxis", "we", "us", or "our"), including related websites, APIs, and services (together, the "Platform").

By creating an account, activating a license, or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who the Platform is for

Trade Bot is a software platform operated by Orpyxis Technologies that provides AI-assisted trading strategy automation, APIs, monitoring tools, and related services (the "Platform"). It does not provide investment advice and does not execute trades as your broker; you remain responsible for exchange accounts, API keys, and trading decisions.

2. Eligibility

You must:

Be at least 18 years old
Provide accurate registration information
Have legal capacity to enter a binding contract
Hold any licences, authorisations, or professional permissions required for how you use the product

We may refuse, suspend, or terminate accounts that do not meet these requirements.

3. Accounts, licenses, and security

You are responsible for keeping login credentials and license keys confidential
Only authorised seats/devices may be activated under your license
Notify us promptly of unauthorised use at [email protected]
You must not share accounts, resell seats without permission, or impersonate others

4. How the service works

Features available to you depend on the product, your role, and your active license plan. In-app descriptions, quotes, and plan terms form part of the commercial understanding for paid features. Payments for licenses and in-product charges may be processed by third parties such as Stripe; we do not store full card numbers on our servers.

5. Your obligations

Provide accurate information
Use the Platform only for lawful purposes
Not abuse, reverse engineer, scrape, or attack the Platform
Not circumvent security, licensing, rate limits, or payment systems
Comply with third-party terms for any services you connect (e.g. exchanges, maps, payment providers)

6. Intellectual property

The Platform, branding, software, and content (excluding your own content) are owned by Orpyxis or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the product for its intended purpose under a valid license.

7. Third-party services

The Platform may integrate maps/routing, payments (e.g. Stripe), email, hosting, analytics, or other providers. Their terms and privacy notices also apply where relevant.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability or that the Platform will meet every operational requirement.

Where the product coordinates third parties (for example independent operators or external exchanges), Orpyxis is a technology provider and is not responsible for the physical or financial services of those third parties unless expressly stated in writing.

9. Liability

TO THE MAXIMUM EXTENT PERMITTED BY MALTESE AND APPLICABLE EU LAW:

We are not liable for indirect, incidental, special, or consequential damages
Our aggregate liability arising from your use of the Platform is limited to the greater of (a) fees you paid to us for the product in the 12 months before the claim, or (b) EUR 100

Nothing in these Terms excludes liability that cannot be excluded by law.

10. Suspension and termination

We may suspend or terminate access for breach, safety risk, fraud, non-payment, or legal requirement. You may stop using the product and request account deletion as described in the Privacy Policy.

11. Changes

We may update these Terms. Material changes will be indicated by updating the "Last Updated" date and, where appropriate, notice in the product or by email. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Malta. Courts of Malta have jurisdiction, without prejudice to mandatory consumer protections that apply in your country of residence if you are a consumer.
